Terms of Service
Welcome to Servolo. These Terms follow common marketplace practices used by home-services platforms and are tailored to how our app works in Canada.
1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Servolo ("we", "us", or "our") governing your use of the Servolo mobile application, website, and related services (collectively, the "Service" or "Platform").
By creating an account, checking the agreement box at registration, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and geographic availability
You must be at least 18 years old and able to enter a binding contract under applicable law.
You may register as a homeowner (to post jobs and hire contractors) or as a contractor (to find and apply for jobs). You are responsible for accurate registration information and keeping your login credentials secure.
You must verify your email address to use the Service. We may require additional verification steps for security or fraud prevention.
The Service is intended for use in Canada. At this time, we make the Service available in: Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Nova Scotia, Northwest Territories, Nunavut, Ontario, Prince Edward Island, Saskatchewan, Yukon.
We do not currently offer the Service in the following jurisdictions because of stricter local legal requirements we are not yet equipped to meet: Quebec.
You may not use the Service if your primary service area or job location is in an excluded jurisdiction. We may block, restrict, or terminate accounts that appear to be located in excluded regions.
3. The Platform is a marketplace only
Servolo operates an online marketplace that helps homeowners and contractors discover each other, communicate, post and apply for jobs, leave reviews, and (for contractors) manage subscriptions.
We do not perform contracting work, employ contractors, supervise jobs, set job prices between users, or guarantee that any job will be completed, paid for, or performed safely or lawfully.
Except for contractor subscription fees paid to us, payments for actual work are arranged directly between homeowners and contractors unless we explicitly introduce an in-app payment feature in the future.
4. Relationship between users
When a homeowner and contractor connect through the Platform, they enter into a direct relationship with each other. Any agreement for work is between those users, not with Servolo.
Contractors are independent businesses. They are not employees, agents, partners, joint venturers, or franchisees of Servolo. Homeowners are customers of contractors, not customers of Servolo for the underlying work performed.
Users have no authority to bind, represent, or make commitments on behalf of Servolo.
5. No employment or agency relationship
The Platform is not an employment service, staffing agency, or general contractor. Servolo does not hire users to perform jobs, direct how work is performed, provide tools or supplies, or withhold taxes on behalf of contractors.
Contractors are solely responsible for their business expenses, insurance, licences, permits, registrations, safety practices, and tax obligations arising from work they perform. Any in-app notes about possible tax treatment of subscription fees are informational only and are not tax, legal, or accounting advice.
6. User accounts
You are responsible for all activity under your account. Notify us immediately at support@servolo.app if you suspect unauthorized access.
We may suspend, restrict, or terminate accounts that violate these Terms, our policies, or applicable law, or that create safety, fraud, or abuse risk for other users or the Platform.
You may stop using the Service at any time. To request account deletion, contact support@servolo.app or privacy@servolo.app. Some information may be retained as described in our Privacy Policy.
Optional biometric unlock (such as Face ID or fingerprint) may store sign-in credentials on your device using the operating system's secure storage. You can disable this in the app. Biometric data itself is handled by your device and is not sent to Servolo.
7. Homeowner responsibilities
If you post a job or hire through the Platform, you agree that:
- Your job descriptions, photos, and communications are accurate, lawful, and not misleading.
- You are solely responsible for evaluating contractors, verifying qualifications, licences, insurance, and references, permitting property access, and agreeing on scope, timing, and price.
- You will not post jobs that are illegal, discriminatory, harassing, unsafe, or intended to circumvent Platform rules.
- Disputes over workmanship, property damage, payment for completed work, or cancellations are primarily between you and the contractor, subject to applicable consumer protection laws.
- You understand that job locations may be shown to contractors at city level until you accept an application, after which more precise address details may be shared with the accepted contractor to perform the work.
8. Contractor responsibilities
If you offer services through the Platform, you agree that:
- You operate as an independent business under your own name or business name, using your own tools, pricing, and methods.
- Your profile information, experience, licences, insurance, and qualifications are accurate to the best of your knowledge.
- You hold all licences, permits, registrations, and insurance required for your trade and location in Canada.
- You may accept or decline jobs, work elsewhere, and maintain customers outside the Platform.
- You are solely responsible for work quality, safety, taxes, invoicing, and legal compliance.
- You will not misrepresent your identity, credentials, reviews, or availability.
- You will comply with application limits, trial rules, and subscription requirements shown in the app.
9. Screening, reviews, and badges
We may display ratings, reviews, categories, or profile information to help users make their own decisions. Unless we expressly state otherwise in writing, we do not guarantee that any contractor is licensed, insured, background-checked, vetted, or suitable for a particular job.
Reviews must reflect genuine experience. We may moderate, hide, or remove reviews that appear fraudulent, abusive, or policy-violating. Contractors may be able to respond to or contest reviews through features we provide, subject to moderation.
Homeowners remain responsible for their own due diligence before hiring. Contractors remain responsible for ensuring they are legally permitted to perform requested work.
10. Work quality, safety, and property damage
Servolo does not guarantee the quality, timing, legality, or outcome of any job or the competence of any user.
If property is damaged, work is defective, or someone is injured in connection with a job, claims are primarily between the homeowner and contractor and any applicable insurers — not Servolo, except where applicable law requires otherwise.
If you believe a user poses a safety risk or engaged in serious misconduct, contact us promptly through in-app support or support@servolo.app.
11. Messaging and user content
You may submit content such as job posts, photos (including portfolio and completion photos), reviews, messages, profile information, and voice-to-text input ("User Content"). You retain ownership of your User Content, but grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and use it as needed to operate, promote, and improve the Service.
You must not submit User Content that is unlawful, false, misleading, harassing, fraudulent, infringing, or harmful.
Private messages are intended for communication between conversation participants. We may access stored messages only for legitimate purposes such as support, safety, fraud prevention, enforcement of these Terms, or compliance with law, as described in our Privacy Policy.
Messaging for a job thread may be limited or closed after a job is completed or when a participant leaves the conversation. Features that share phone numbers or addresses within chat are controlled by the users who choose to share them.
12. Artificial intelligence features
The Service may use artificial intelligence tools to help clean up spoken or typed job text, suggest grammar improvements, and recommend service categories. These features are assistive only. You remain responsible for reviewing and approving final job content before posting.
AI outputs may be imperfect. Do not rely on them as professional, legal, or trade advice. By using these features, you agree that relevant text may be processed by third-party AI providers as described in our Privacy Policy.
13. Prohibited conduct
You may not use the Service to:
- Violate any law or third-party rights.
- Post false, deceptive, or discriminatory jobs or profiles.
- Harass, threaten, spam, or attempt to defraud other users.
- Circumvent Platform fees, messaging systems, application limits, free-trial rules, safety features, or abuse controls.
- Create multiple accounts to obtain extra free trials, evade blocks, or manipulate reviews.
- Scrape, reverse engineer, or interfere with Platform security or operation.
- Use another person's account or provide false identity information.
14. Subscriptions and payments (contractors)
Certain contractor features may require a paid subscription. Prices, billing intervals, free-trial rules, daily application limits, and included features are shown in the app before purchase or use.
Subscription payments are processed by Stripe or other third-party payment providers and may include options such as Google Pay where available. By subscribing, you authorize recurring charges according to the plan you select until you cancel.
You may cancel through the subscription screen in the app, which may direct you to a secure billing portal. If you cancel, access typically continues until the end of the paid period when cancellation is scheduled for period end. Cancellation stops future subscription charges but does not automatically refund amounts already paid except where required by applicable law.
We may change subscription pricing or features with reasonable notice where required by law. We may also offer complimentary Pro access or revoke access for fraud, abuse, chargebacks, or Terms violations.
15. Third-party services
The Service may integrate with third parties such as authentication and database hosting providers, Stripe, mapping and geocoding providers, speech-recognition or AI providers, app-store platforms, and push notification providers. Your use of those services may be subject to their own terms and privacy policies.
We are not responsible for third-party websites, services, outages, or acts of other users.
16. Electronic communications
You consent to receive communications from us electronically, including account notices, service messages, push notifications you enable, in-app notifications, and legal updates. You agree that electronic communications satisfy any legal requirement that such communications be in writing, where permitted by law.
You can control many notification preferences in your profile settings. Service-related messages required to operate your account may still be sent.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant uninterrupted or error-free operation, or that users or jobs will meet your expectations. We do not vet every user and do not guarantee job outcomes, workmanship, timeliness, payment between users, or the accuracy of user-provided information or AI suggestions.
18. Limitation of liability
To the fullest extent permitted by applicable law, Servolo and its operators, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, property damage, or business interruption arising from your use of the Service or any interaction with another user.
Our total liability for any claim relating to the Service will not exceed the greater of (a) CAD $100 or (b) the amount you paid us in subscription fees in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable consumer protection laws.
19. Indemnity
You agree to defend, indemnify, and hold harmless Servolo from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your interactions with other users, work you perform or arrange through the Platform, or your violation of these Terms or applicable law.
20. Disputes with other users
Disputes between homeowners and contractors should first be addressed directly between those parties.
We may, but are not obligated to, review reports or help facilitate communication. We are not a party to your agreements for work performed and are not required to mediate, arbitrate, or resolve user-to-user disputes.
21. Disputes with Servolo
Before starting formal legal action, we encourage you to contact us at support@servolo.app so we can try to resolve the issue informally.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
Subject to applicable consumer protection laws, you agree that courts located in Ontario, Canada have jurisdiction over disputes arising from these Terms or the Service.
22. Changes
We may update these Terms from time to time. We will post the updated version in the app and update the "Last updated" date. Material changes may also be communicated by email or in-app notice where appropriate.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms, except where prohibited by applicable law.
23. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver of our right to do so later.
These Terms, together with the Privacy Policy, are the entire agreement between you and Servolo regarding the Service.
